Error to the Court of Civil Appeals for the First District, in an appeal from Harris County. Murphy sued the railway company and judgment for defendant was affirmed on his appeal, whereupon he obtained writ of error.

BROWN, Associate Justice.

Murphy sued the railroad company to recover damages for a personal injury alleged to have been received by him while he ivas in the employ of the railroad company, and while he was in discharge of his duties as section foreman. The trial court, upon the conclusion of the evidence, instructed the jury to return a verdict for the defendant, Avhich was accordingly done, and judgment entered thereon in favor of the railroad company. Upon appeal by Murphy the Court of Civil Appeals affirmed the judgment.
