MEMORANDUM OPINION
CACHERIS, District Judge.
This case provides one of the first opportunities for a court to apply the in rem proceeding established by Congress as part of the Anti-Cybersquatting Consumer Protection Act (“the ACPA”), 15 U.S.C. § 1125(d)(2) (West Supp.2000). The Court is faced with two important questions. Of particular importance to the ACPA, this Court must determine the nature of a plaintiffs burden to prove the “absence” of personal jurisdiction in order to proceed in rem.
