On July 2, 2010, Plaintiff Builders Mutual Insurance Company (“Plaintiff’ or “Builders Mutual”) filed a Complaint in this Court, seeking a declaratory judgment that it has no duty to defend or indemnify The Futura Group, L.L.C. (“Futura”) with respect to claims brought against Futura in state court by Benjamin R. Proto and Holly Proto (the “Protos”).
