GRIM, District Judge.

By a contract dated May 12, 1948, plaintiff agreed to furnish the labor and-materials to do the brickwork in a large building development of the defendant for $1,420,000. Plaintiff completed the work, but defendant held back and refused to pay to plaintiff $50,068.74 out of the contract price contending that the work had not been done satisfactorily. In this action plaintiff has sued for this' sum. At the trial the jury awarded plaintiff a verdict in the sum of $56,500.
