The Paternity Act, before being amended, impermissibly discriminated against illegitimate children by denying them the opportunity accorded legitimate children for modification of agreements providing for their support.1 “[A] State may not invidiously discriminate against illegitimate children by denying them substantial benefits accorded children generally.” Gomez v Perez, 409 US 535, 538; 93 S Ct 872; 35 L Ed 2d 56 (1973). Therefore, I would affirm the Court of Appeals decision and *283remand the case for further consideration of the parties’ arguments pertaining to retroactivity.2
