In an information filed in the District Court for Douglas County on August 19, 1976, Roosevelt Par-tee, the defendant and appellant herein, was charged with murder in the second degree under section 28-402, R. R. S. 1943. Defendant pled not guilty and not guilty by reason of insanity. Trial commenced on November 15, 1976, and a jury found the defendant guilty as charged. Defendant’s motion for new trial was overruled, and he was sentenced to a term of 25 years imprisonment in the Penal and Correctional Complex.
