The question involved: Did Watauga County contract a debt of $25,000 within the meaning of Article V, section 4, of the Constitution of the State of North Carolina during the fiscal year ending 30 June, 1939? We think so, under the facts and circumstances of this case.

An interpretation of certain sections of law will decide the issue involved. One question is from the N. C. Constitution, Art. Y, sec. 4, as, amended. This section, in part, is as follows: “And counties and municipalities shall not contract debts during any fiscal year, to an amount exceeding two-thirds of the amount by which…
