— Appeal by defendant from a judgment of the County Court, Westchester County (Leggett, J.), rendered November 6, 1978, convicting him of burglary in the third degree and criminal possession of stolen property in the second degree, upon a jury verdict, and imposing sentence.

Judgment reversed, on the law, and new trial ordered. The findings of fact are affirmed.
