delivered the opinion of the court.
Mrs. Nellie McGrraham, the widow of a policeman, filed in the Circuit Court of Winnebago county a petition for a writ of mandamus against the trustees of the policemen’s fund of the City of Rockford to command them to pay her $1,040 from the pension fund. The trustees filed a general and special demurrer to said petition. Afterwards, by leave of court, they withdrew said demurrer, and filed another general and special demurrer in which more grounds of special demurrer were alleged.
