This action was brought by Marion R. Smith-wick, a minor, by Marion A. Smithwick, his father, as his guardian ad litem, and by Marion A. Smithwick, in his personal capacity, for damages resulting from an accident wherein the minor plaintiff was injured by a freight train of the defendant company. The jury returned two verdicts, one for the minor in the sum of $6,000 on account of the personal injuries suffered by him and one for $735 in favor of the father on account of medical and surgical attention and hospital care.
