Plaintiff Richards brought a civil action based upon diversity of citizenship against defendant, Attorneys’ Title Guaranty Fund, Inc. (Attorneys’ Title), a title insurance company. 28 U.S.C. § 1332 (1966). Richards sought to recover from Attorneys’ Title $430,000 in funds that the president of Centennial Escrow Services, Inc. (Centennial) embezzled from Centennial’s trust account.
