This is an appeal fx’om a decree of the Oix’cuit Coux*t No 2 of Baltimore City, dismissing the bill of the appellant, in which it is sought to restrain the Oity of Baltimore from collecting a paving assessment against the property of the appellant, abutting upon a private alley in the City of Baltimore.

The assessment was made under and by authority of an ordinance of the Mayor and City Council of Baltimore, known as‘Ordinance No. 13, approved October 23rd, 1905, and passed pursuant to sections 486 to 492, inclusive, of the City Charter.
