THIS MATTER is before the Court on Defendant Allstate’s Motion for Summary Judgment [D.E. 70] and Plaintiff Said Wiggins’ Motion for Summary Judgment [D.E. 66]. For the reasons stated below, Defendant’s Motion is DENIED and Plaintiffs Motion is DENIED.

I. Background

This bad faith action arises from an automobile accident involving Plaintiff Said Wiggins on June 1, 2008. At the time of the accident, Wiggins was driving an automobile owned by his girlfriend’s mother, Phyllis Albury, an insured under Allstate policy number 94171159109/20 [D.E. 71 ¶ 1].…
