In January, 1851, the appellant, William Davenport and James McDaniel, by appointment from the county court of Harrison county, became the administrators of the estate of Thomas Murphy, deceased, and have since continued to act in that capacity. At the August term, 1859, of said court, their exhibit and ábcount of the condition of said estate, which had been previously filed, was presented to the court, on their application for a final settlement of their administration on said estate.
