The plaintiff brought an action in assumpsit against the defendant, appellant, to recover $140, of which $30 was for balance due on a written contract for work and labor performed, $20 for extra work alleged to have been done, and $90 for lumber which plaintiff alleged defendant ordered through its agents or representatives but which was not included in the written contract. The defendant filed an affidavit of defense as to the items above mentioned and a counterclaim of $300 as damages for plaintiff’s failure to carry out the terms of the written contract. The…
