LEE, District Judge.
This matter is before the court for a decision on the merits following a bench trial, held July 13, 1984. Plaintiff brought this damage action pursuant to 39 U.S.C. § 409, alleging that the defendant is liable upon a contract of insurance between it and plaintiff for the full value of a lost package, sent via Express Mail Next Day Service, worth $7,500.00.
