The facts of this case, so far as it is necessary to state them for decision of it, are that on the 2d of October, 1880, the FTew England Mutual Life Insurance Company issued a policy of life insurance on the life of William Baker for §5,000, for the benefit of Mary S. Baker, his wife, the appellee. He died on the 15th day of February, 1886, she surviving.
On the 14th of December, 1885, he and she made a promissory note, payable in ninety days thereafter, to the order of W. H. Kretsinger, for §600, with a warrant of attorney attached to confess judgment, and a recital that as security for the…
