HALL, Justice.
On May 17, 1939, appellees, Mrs. Carolina B. Hightower, joined by her husband, C. E. Hightower, instituted this suit in the District Court of Smith County against appellant for the balance due on a note dated January 18, 1933, payable twenty-four months after date. It was alleged that during the early part of January, 1938, after the note had been placed in the hands of appellees’ attorney for collection, “Thomas K.
