FINDINGS OF FACT AND CONCLUSIONS OF LAW

LAMBROS, District Judge.

Plaintiffs have brought this action against the Consolidated Rail Corporation (Conrail) seeking declaratory relief, injunctive relief, and damages for Conrail’s alleged improper termination of rail service at the former Erie Lackawanna Ore Dock located on the Cuyahoga River.

By its prior order of May 4, 1976 the Court granted the plaintiffs’ motion for a temporary restraining order enjoining Conrail from discontinuing service at the Erie Dock. However, the Court stayed execution of its order pending a determination by the Special…
