OPINION
SWEET, District Judge.
Plaintiff Turner Construction Company (“Turner”) has moved pursuant to Rule 56, Fed.R.Civ.P., for summary judgment on Count One of its Second Amended Complaint (“SAC”) against defendants American Manufacturers Mutual Insurance Company (“AMMIC”) and Lumberman’s Mutual Casualty Company (“LMCC”) (collectively, the Defendants”). The Defendants have also moved for summary judgment dismissing all claims against the Defendants. For the reasons set forth below, the motion of Turner is granted, and the motion of the Defendants is granted in part and denied in part.
