Bliss, J.—

The defendant was the mayor of the city of Denison. On May 23, 1942, an information was presented to him and filed in his office, accusing the plaintiff of ‘ ‘ unlawfully, willfully and feloniously keeping bees which have become a nuisance. ’ ’ The defendant issued a warrant for plaintiff’s arrest, charging him with the crime of keeping bees which had become a nuisance, and under it the plaintiff was arrested by the marshal and brought before the mayor. At that time the plaintiff and his attorney informed the mayor that there was no ordinance authorizing the issuance of the warrant…
