Appeal by the plaintiff, Johanna Brogan, as administratrix, etc., of Michael Walsh, deceased, from a judgment of the- Supreme Court in favor of the defendants, entered in the office of the clerk of the county of Kings on the 4th day of January, 1900, upon the dismissal of the complaint by direction of the court after a trial before the court and a jury at the Kings County Trial Term.

Jenks, J.:

This action is brought to recover damages for the death of plaintiff’s intestate, caused by the negligence of the defendants. It is alleged that in the night time the intestate fell to his death down the steps of an entrance to the basement of premises in the city of New York. At that time the premises were owned by Duncan, who had leased the store and basement to defendants, who in turn had leased the basement to Abramson.
