In a hybrid proceeding pursuant to CPLR article 78 and action, inter alia, to recover damages for breach of an employment contract, the petitioner/plaintiff appeals, as limited by her brief, *817from, so much of an order and judgment (one paper) of the Supreme Court, Suffolk County (Molla, J.), dated December 16, 2009, as, in effect, granted that branch of the respondent/defendant’s motion which was to dismiss the third cause of action alleging breach of contract, and dismissed that cause of action.

Ordered that the order and judgment is reversed insofar as appealed from, on the law, with costs,…
