This is the second time we have considered this case. On the first occasion, we granted the State’s motion for direct certification to review the dismissal by the Superior Court, Law Division, of the municipal court presentment charging the defendant, Dr. Harry D. Sugar, with the murder of his wife. The dismissal was based on the unlawful tape-recording by the arresting police officers of a privileged and confidential conversation between the defendant and his attorney while defendant was still in police custody following his arrest.
