MEMORANDUM

WANGELIN, District Judge.

This action is before the Court upon the motion of the defendant, Federal Crop Insurance Corporation, for summary judgment pursuant to Rule 56, Federal Rules of Civil Procedure.

This action originally was commenced in the Circuit Court of New Madrid County, Missouri, on December 30, 1971, and was removed to this Court pursuant to 28 U.S.C. § 1441(a). The petition for *929removal was filed January 27, 1972; it recites that service of plaintiff’s petition was made on defendant on December 30, 1971.
