Appeal from a judgment of the County Court of Schenectady County (Giardino, J.), rendered January 28, 2008, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the third degree.

Defendant was arrested after a police investigator, who was watching live video through a surveillance camera, observed him selling crack cocaine over a three-hour period on a street corner in the City of Schenectady, Schenectady County.
