The petitioners, E. R. Norton, A. G. Wheeler and W. S. Fox, partners trading under the firm name of Norton-Wheeler Stave Company, and Bert McCarthey filed here their petition for a writ of prohibition against the Hon. DuVal L. Purkins, judge of the Cleveland circuit court, and as grounds therefor alleged the following facts:
