OPINION AND ORDER

In this federal civil rights case based on the alleged use of excessive force by the police, an Assistant Corporation Counsel (“the ACC”) representing the City of New York made an Offer of Judgment in writing pursuant to Fed.R.Civ.P. 68 for $45,001 plus attorney’s fees. (The ACC has since left the Corporation Counsel’s Office for reasons unrelated to this case.) Plaintiffs attorney accepted the Offer of Judgment in writing. Later that same day, however, the ACC informed plaintiffs counsel that she did not have authority…
