The plaintiff, Fidelity-Bankers Trust Company, a corporation of the State of Tennessee, commenced this action against the defendants, Dever Eittle and Maud S. Little, in the Court of Common Pleas for Cherokee County, March 12, 1934. The purpose of the action is to recover against the defendants, who are residents of Cherokee County, this State, judgment in the sum of $11,729.30, alleged to be the balance due on a note of the defendants executed to the plaintiff, June 30, 1930, and secured by a trust deed or mortgage executed by the…
