MEMORANDUM AND ORDER

ROGERS, District Judge.

This is a civil rights, personal injury and wrongful death case. This case arises from a conflict which developed between a driver and police officers during a traffic stop. During the conflict, the driver, Kelly Reindl, was forced to the ground and was struck multiple times by a police officer with a baton. He died several months later. It is disputed whether his death was caused by the actions of the police. His sister-in-law and mother have sued the City of Leavenworth and members of the Leavenworth Police Department in this case.
