The plaintiff claimed to be a riparian owner of a tract of land, long used as his family homestead, located on the eastern shore of the Susquehanna River opposite Duffy’s Island. He complained that the defendant had obstructed the river between this land and the island, known as the Eastern Channel, in such a way and manner as to divert the water and make the channel practically dry during the summer season, causing irreparable damage to his property.
