Appeal from a judgment of the superior court for King county, Linn, J., entered November 15, 1901, upon findings in favor of the plaintiff, after a trial on the merits before the court without a jury, in an action to quiet title.

In October 1904, one George P. Ross-man began an action in the superior court of King county against the respondent and others to recover upon an account for legal services rendered a brother of the respondent. At the time of commencing the action, he sued out a writ of attachment, and caused the same to be levied on certain real estate belonging to the respondent, situated in Thurston *432county. Personal service could not be had upon the respondent, and the following summons was served by publication :
