Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Appellate Division, Second Department) to review a determination of respondent which terminated petitioner’s employment as a school bus driver.

Petitioner, a bus driver for the Washingtonville Central School District in Orange County, was charged pursuant to Civil Service Law § 75 with (1) operating of a school bus in an unsafe, uncontrolled and negligent manner, (2) causing $12,600 worth of damages as a result thereof, and (3) failing to report the resulting accident.
