Defendant, Villa Sierra Development, was a joint venture that was formed to develop the Villa Sierra condominium project in Colorado Springs; Field Corporation (Field), as the sole, surviving joint venturer, is its successor. They appeal from a declaratory judgment entered in favor of plaintiffs, Villa Sierra Condominium Association (the association), a non-profit homeowners’ corporation, and Warren Cramer, who represent a class of all present condominium unit owners within the project.
