*456 In Anglin v. Smith , Case No. A16A1405 (October 12, 2016), this Court granted Mittie Anglin and her husband a new trial in their medical malpractice action against Dr. Stephanie Smith and Gwinnett Anesthesia Service, P.C. (GAS).

*457 This Court determined that, regardless of whether the plaintiffs' counsel had a duty to disclose a certain affidavit to the defense as part of pre-trial discovery, when the plaintiffs attempted to utilize the affidavit in the course of trial, the trial court erred by excluding the affidavit.
