In this action the plaintiff had judgment restraining the defendant as constable of the third township in and for the county of Tuolumne, from selling a Cadillac tow car and a Chevrolet truck under an execution issued by the Justice’s Court of Sacramento Township, Sacramento County.

On the 31st day of August, 1933, Sacramento board of trade, a corporation commenced an action in the Justice’s Court of Sacramento Township, against the plaintiff in this action. The sum claimed or the amount of the demand in that action was less than the sum of $300, and was within the jurisdiction of justices’…
