I. Introduction
Appellant and Cross-Appellee C. Green Scaping, L.P. (“CGS”) sued Appellee and Cross-Appellant Westfield Insurance Company (“Westfield”) on a payment bond issued by Westfield under section 2253 of the Texas Government Code. Following a bench trial, the trial court entered judgment for CGS. In two issues, CGS challenges the sufficiency of the evidence supporting the trial court’s finding that CGS was liable for liquidated damages in the amount of $15,000 and argues that the trial court abused its discretion by not awarding CGS attorney’s fees.…
