This is an action for damages alleged to have been sustained by the plaintiff in consequence of being expelled from one of the defendant’s passenger trains upon which the plaintiff was •traveling as a passenger. . The plaintiff’s case is this ; He is a resident of Mobile, Alabama. On the 21st of June, 1880, he purchased of James W.
