—■ Appeal from a judgment of the Supreme Court, Westchester County, entered December 23, 1968, which dismissed plaintiff’s complaint on jurisdictional grounds. Judgment reversed, on the law and the facts, without costs, and ease remitted to the court below for further proceedings not inconsistent herewith and for a determination on the merits. This is an action to enjoin defendant (plaintiff’s wife) from prosecuting an action for divorce, which she has commenced in the State of Florida.
