Levine, J.

This action was commenced by plaintiff, the State of New York (hereinafter the State), to recover $75,000, the amount defendant undertook to guarantee as surety under a bond for the payment of New York taxes due from Gasoline Marketers of America, Inc. (hereinafter GMA), a New Jersey corporation. The bond was originally issued by defendant in 1976, pursuant to the requirements of Tax Law § 283, when GMA applied for registration as a New York distributor of motor fuels.
