Appeal by the defendant from a judgment of the Supreme Court, Kings County (Deeley, J.), rendered October 29, 1984, convicting him of attempted robbery in the first degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial, after a hearing, of that branch of the defendant’s omnibus motion which was for the suppression of evidence.

Judgment affirmed, and case remitted to the Supreme Court, Kings County, for further proceedings pursuant to CPL 460.50 (5).

It was not error for the prosecution to question an alibi witness about her prior failure to come forward…
