This suit was brought to foreclose a mechanic’s lien upon the property of the Indianapolis Light *514& Heat Company, a corporation which had been formed by consolidation of the Marion County Hot Water Heating Company, and the Indianapolis Light & Power Company. Appellant filed a cross-complaint in the suit, alleging that the Marion County Hot Water Heating Company had contracted with J. J. Smith & Company for the construction of a certain sewer and drain, and,' for the purpose of executing said contract, J. J. Smith and J. J.
