Acting under 19 U.S.C. § 1305, 1 the United States instituted this forfeiture proceeding against ten allegedly obscene paintings and drawings. Claimants, Dr. Eberhard Kronhausen and his wife, Dr. Phyllis Kronhausen, 2 the owners and collectors of the pictures, filed a motion to dismiss under Federal Civil Rule 12(b) (6) and a motion for summary judgment under Federal Civil Rule 56, contending that none of the objects is obscene and that section 1305 is both facially, and as applied in the present case, unconstitutional.
