Elbert F. Elmore (hereinafter defendant) appealed from the judgment of the circuit court of Cook County in the amount of $40,000 entered in favor of plaintiffs, George E. Lombard and Michael A. Lombard, upon allowance of their motion for summary judgment. Plaintiffs appealed from the judgment entered against them in the amount of $46,750 entered on the jury verdict returned in favor of defendant on his counterclaim. The appellate court reversed the summary judgment entered against defendant and affirmed the judgment entered in favor of defendant on the counterclaim. (134 Ill. App. 3d 898.) We…
