{¶ 1} Appellant, the city of Wadsworth, has appealed from the judgment of the Wayne County Court of Common Pleas, which dismissed its petitions for appropriations. This court reverses the judgment.

{¶ 2} In February 2002, plaintiff-appellant, the city of Wadsworth, entered into an agreement with the city of Barberton, wherein Wadsworth obtained a perpetual easement for approximately 17 acres of land owned by Barberton in Chippewa Township in Wayne County (the “Chippewa Creek property”).
