This appeal stems from a wrongful death action where plaintiff’s decedent was killed in a construction accident. The accident occurred at the Presque Isle Power Plant while decedent was working as a boilermaker for third-party defendant — subcontractor Riley Stoker Corporation. Plaintiff brought a suit against the owners of the plant 1 and against the general contractor, Bechtel Power Corporation.
