This is an action of trespass and false imprisonment brought by Lewis W. Geek, the plaintiff below and defendant in error, against Oliver L. Shepherd, the defendant below and plaintiff in error. The defendant, Oliver L. Shepherd, is and was at the time of the institution of this suit, an officer of the United States, stationed at Fort Defiance, in the county of Bernalillo. The action is for personal injuries and destruction of personal property belonging to the plaintiff, Lewis W. Geek, a resident of the county of Doña Ana.
