Petitioner, Maggie Pendleton, was granted a decree signed by the court on September 11, 1990, dissolving her marriage to respondent, Lloyd Pendleton. However, she appeals from that portion of the decree which denied her request for a division of marital property accruing since an earlier decree of legal separation and denied her request for alimony. In addition, petitioner asks for attorney’s fees in this action.

The basic question presented by this appeal is whether the provision of Neb. Rev. Stat. § 42-365 (Reissue 1988), which prevents the later modification of a decree of dissolution to…
