McCALEB, Justice.
Plaintiff, Malcolm D. Slaton, prior to his marriage to defendant, Willa Lee Slaton King, on August 10th, 1935, was the holder and owner of a certain mortgage note made and signed by one Green Rowden, dated December 31st, 1931, for the principal sum of $537.60. This note was identified with an act of mortgage executed by said Row-den, wherein he hypothecated, as security-for its payment, 40 acres of land owned by him in Lincoln Parish.
