Marshall, J.:

This is the second time this case has been in this court. (Robertson v. Labette County Comm’rs, 122 Kan. 486, 252 Pac. 196.) The plaintiff was employed by Labette county in the *706construction of a hard-surface road in that county and was accidentally injured while working for the county on the road. The Federal Surety Company had issued a policy of insurance to indemnify the board of county commissioners against personal injuries sustained by employees, and—

“To pay promptly to any person entitled thereto, under the workmen’s compensation law…
